These terms and conditions explain the basis on which you may use this website and the terms that may apply when you reserve a motorcycle, place a deposit, make an enquiry, request finance information, book a service or otherwise contact us through this website.

By using this website, you agree to these terms and conditions. If you do not agree with them, please do not use this website.

Website use

This website is provided for information, enquiry, reservation and contact purposes. We do not generally sell goods directly through this website, although we may from time to time allow customers to place deposits or reservation payments for motorcycles or other goods.

We try to keep all information on this website accurate and up to date, but errors can occur. Prices, specifications, availability, finance examples, offers, images, mileage, accessories, colours and other details may change or may be entered incorrectly.

Nothing on this website should be treated as a binding offer to sell a motorcycle, product or service at the price or specification shown. Any purchase remains subject to our acceptance, vehicle availability, confirmation of details, and any further written agreement or order form.

We reserve the right to amend, remove or correct any information on this website at any time.

Motorcycle availability, pricing and specification

Motorcycle stock shown on this website is subject to availability and may be sold, reserved, withdrawn, changed or repriced without notice.

New motorcycle specifications, colours, accessories, model years, manufacturer promotions and delivery dates are subject to change by the manufacturer or importer.

Used motorcycle descriptions are provided in good faith. Mileage may increase slightly where a motorcycle is moved, tested, demonstrated or used for operational purposes. Images may include library photographs or photographs taken before preparation work has been completed.

Before you enter into a purchase, we will confirm the key details of the motorcycle with you, including price, registration status, mileage, accessories, warranty position, finance details where applicable, and any agreed preparation work.

Deposits and reservations

Where this website allows you to place a deposit or reservation payment, that payment is normally intended to reserve a specific motorcycle or to show serious intent to proceed with a purchase.

A deposit or reservation payment does not by itself create a completed contract for the sale of the motorcycle. A contract will only be formed when we have accepted your order or reservation and confirmed the details of the purchase with you.

We reserve the right to refuse or cancel a reservation where:

• the motorcycle is no longer available;
• the price, description or finance information was shown incorrectly;
• we suspect fraud, misuse or an unauthorised payment;
• we are unable to verify your details;
• the motorcycle cannot be supplied for reasons outside our reasonable control;
• finance approval, where required, is not obtained; or
• there is another reasonable commercial or legal reason why we cannot proceed.

If we cancel a reservation before a contract has been formed, we will refund any deposit or reservation payment you have made.

If you cancel after placing a deposit, your rights may depend on whether the motorcycle was reserved from stock, specially ordered, prepared, registered, accessorised or otherwise altered at your request. We will always deal with cancellations in accordance with your statutory rights.

Nothing in these terms affects your statutory rights as a consumer.

Distance and off-premises sales

Where a contract is made with a consumer at a distance or away from our premises, you may have cancellation rights under consumer protection legislation.

These rights do not apply in every situation. For example, cancellation rights may be limited or excluded where goods are made to your specification, clearly personalised, or where services have already started with your agreement. Where a motorcycle has been specially ordered, registered, accessorised or prepared at your request, we will explain how this affects your rights before or at the point the contract is agreed.

We will provide any required cancellation information at the appropriate stage of the purchase where those rules apply. Where a consumer contract is made at a distance or away from our premises, we will provide the information required under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

Finance

Newcastle Motorcycles Ltd is authorised and regulated by the Financial Conduct Authority as a non-independent credit broker. Our FCA registration number is 660607.

We are a credit broker, not a lender. This means we can introduce you to finance providers from our limited panel who may be able to help you finance your motorcycle, subject to status, affordability and the lender’s own criteria. Our panel includes lenders such as Honda Finance Europe, MotoNovo Finance, Santander Consumer Finance and Black Horse Finance, although our lender panel may change from time to time. We do not search the whole market. The lender will decide whether to offer finance and, if so, on what terms.

Finance is subject to status, age, affordability, credit checks and lender approval. Terms and conditions apply. Guarantees or indemnities may be required. Finance is normally available only to UK residents aged 18 or over.

Any finance figures shown on this website are examples only unless clearly stated otherwise. Monthly payments, deposits, APR, term, final payments and total amounts payable may change depending on the motorcycle, lender, offer period, credit status, mileage, deposit and other factors.

Manufacturer finance offers may be varied, withdrawn or extended at any time. Offer periods, registration deadlines and eligibility criteria are set by the relevant manufacturer, importer or finance provider.

We may receive commission or other remuneration from the lender or another third party if you enter into a finance agreement following our introduction. This is not a fee that you pay directly to us. The commission may be a fixed amount, a percentage of the amount financed, or calculated in another way agreed with the lender. The amount may vary depending on the lender, finance product, motorcycle brand, motorcycle promotion, amount financed, term or manufacturer support. The commission we receive may differ from one finance option to another. For example, a manufacturer finance promotion may have a different APR and a different commission arrangement from a standard panel finance product. The commission may affect the finance products we introduce to you and, depending on the arrangement, may affect the amount payable by you under the finance agreement.

You may ask us for further information about the commission or remuneration we may receive before you enter into a finance agreement.

You are not obliged to take finance through us and you may seek independent finance or pay by other agreed means.

Part exchange valuations

Any part exchange valuation provided through this website, by email, by telephone or otherwise before physical inspection is an estimate only.

A final part exchange value will depend on inspection of the motorcycle, its condition, mileage, service history, ownership history, documentation, keys, accessories, finance status, market conditions and any undisclosed damage or faults.

We reserve the right to amend or withdraw a part exchange valuation if the motorcycle differs from the information supplied to us or if market conditions materially change before completion.

Test rides

Test rides are subject to availability, insurance approval, licence checks, age restrictions, weather conditions, road conditions and our discretion.

You may be required to provide a valid driving licence, National Insurance number, proof of address and other information before a test ride. You may also be required to sign a test ride agreement and accept responsibility for insurance excesses, penalties, damage or misuse.

We reserve the right to refuse a test ride.

Service, workshop and repair bookings

Where this website allows you to request or book service, MOT, repair, diagnostic or workshop work, the booking is not confirmed until accepted by us.

Any estimate given before inspection is an estimate only. Additional work may be required once the motorcycle has been inspected or dismantled. We will seek your authority before carrying out additional chargeable work unless otherwise agreed.

You are responsible for ensuring that your motorcycle is roadworthy, insured and legal when delivered to or collected from us, unless we have expressly agreed otherwise.

Warranties and guarantees

New motorcycles are supplied with the manufacturer’s warranty, subject to the manufacturer’s terms and conditions.

Used motorcycles may be supplied with a warranty, guarantee or statutory protection depending on the motorcycle, age, mileage, price and the terms agreed at sale. Details will be confirmed with you before purchase.

Manufacturer warranties and third-party warranty products are subject to their own terms, conditions, exclusions and claim procedures.

Nothing in these terms affects your statutory rights.

Manufacturer information and third-party content

This website may include manufacturer information, finance examples, videos, images, offers, brochures, technical data, links or other third-party content.

We are not responsible for the accuracy, availability or content of third-party websites. Links are provided for convenience only and do not mean we endorse or accept responsibility for those websites.

Payment security

Where online payment functionality is available, payments may be processed by a third-party payment provider. We do not intentionally store your full card details on our website.

You must ensure that any payment details you provide are accurate, that you are authorised to use the payment method, and that sufficient funds are available.

We reserve the right to cancel or refuse any transaction where we suspect fraud, unauthorised use, error or misuse.
